MenuScout Terms of Service

By downloading, installing, or using MenuScout (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Service Description

MenuScout is a mobile application that uses artificial intelligence to analyze restaurant menu images and provide health scores and estimated nutrition information based on user-defined goals and dietary preferences.

2. Nutrition Disclaimer

Important: All nutrition information provided by MenuScout — including calorie counts, macronutrient estimates, and health scores — is generated by AI and represents approximations only. These estimates are not verified by registered dietitians or nutritionists, are not based on laboratory testing, and may be significantly inaccurate.

MenuScout nutrition data should not be used as the basis for medical, therapeutic, or clinical dietary decisions. Always consult a qualified healthcare provider or registered dietitian for specific dietary guidance, particularly if you have a medical condition.

  • Do not disregard or delay seeking medical advice because of information provided by MenuScout
  • MenuScout is not responsible for adverse health outcomes resulting from dietary decisions made using this service
  • Always verify nutritional information and ingredients directly with the restaurant

4. Account and Eligibility

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree not to share, sell, or transfer your account to another person.

5. Subscription Terms

  • Free tier: 3 menu scans per month, no payment required.
  • Pro ($4.99/month): 30 scans per month, AI chat follow-ups, modification suggestions.
  • Premium ($9.99/month): 60 scans per month, extended AI chat, web research integration.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your App Store or Google Play account settings.
  • Refunds are subject to Apple App Store and Google Play Store refund policies.
  • We reserve the right to change subscription pricing with 30 days’ notice.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or abuse the Service’s API.
  • Upload content that is illegal, offensive, or violates any third party’s rights.
  • Use automated tools or bots to interact with the Service.

7. Intellectual Property

All content, features, and functionality of MenuScout — including the app design, AI models, and branding — are owned by MenuScout and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, MenuScout shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to health decisions made based on the Service’s output or data loss.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We reserve the right to suspend or terminate your account for violations of these Terms. You may delete your account at any time from within the app.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
